1. Agreement to Terms

By accessing or using Private Crypto Swap ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Service Description

Private Crypto Swap provides a software interface that enables users to execute cryptocurrency swaps through third-party service providers, including but not limited to Houdini Swap and its network of liquidity partners.

We are an interface provider only. We do not:

• Take custody, control, or possession of your cryptocurrency assets
• Execute trades or swaps directly
• Act as a broker, dealer, exchange, or financial intermediary
• Provide investment advice or recommendations
• Guarantee swap execution, timing, or pricing

All swap execution is performed by third-party providers subject to their own terms, conditions, and compliance requirements.

3. Eligibility and Restrictions

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use this Service.

The Service is NOT available to persons or entities:

• Located in, resident in, or citizens of sanctioned jurisdictions including Cuba, Iran, North Korea, Syria, Russia, Belarus, or the Crimea, Donetsk, or Luhansk regions
• Located in, resident in, or citizens of the United Arab Emirates
• Listed on any sanctions list maintained by OFAC, UN, EU, or similar authorities
• Using the Service on behalf of any such persons or entities
• Located in any jurisdiction where use of this Service would be prohibited

You represent and warrant that you are not subject to any of the above restrictions.

4. Prohibited Uses

You agree NOT to use the Service for:

• Money laundering or terrorist financing
• Sanctions evasion or circumvention
• Tax evasion or fraud
• Processing proceeds of crime
• Any illegal activity under applicable laws
• Circumventing geographic or access restrictions
• Any activity that would cause us to violate any law or regulation

5. Third-Party Services

The Service integrates with third-party providers (including Houdini Swap) for swap execution. Your use of these third-party services is subject to their respective terms of service and privacy policies.

We are not responsible for:

• Third-party service availability, performance, or failures
• Swap execution delays, failures, or pricing discrepancies
• Any AML/KYC holds, freezes, or compliance actions by third parties
• Loss of funds due to third-party errors or insolvency
• Actions taken by third parties pursuant to their compliance obligations

Third-party providers may perform compliance checks, hold transactions for review, or refuse service at their discretion.

6. Risks

Cryptocurrency trading involves substantial risks including:

• Complete loss of your cryptocurrency assets
• Extreme price volatility
• Transaction finality with no possibility of reversal or chargeback
• Smart contract vulnerabilities or exploits
• Network congestion, delays, or failures
• Regulatory actions affecting service availability
• Loss due to incorrect wallet addresses (transactions cannot be reversed)

You acknowledge that you understand these risks and that you are solely responsible for any losses you may incur.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE FEES (IF ANY) PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Private Crypto Swap and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of any third party.

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.
